The legal basis
Austria has a state monopoly on online gambling. Under § 3 of the Austrian Gambling Act, any operator targeting Austrian players needs a concession granted by the Ministry of Finance. Only a single operator holds such a concession in Austria.
Every other online casino lacks an Austrian concession and therefore operates without a legal basis on the Austrian market. Whatever you deposited and lost under such an invalid gambling contract can be reclaimed under civil law. The Austrian Supreme Court has confirmed this line in settled case law, most recently in OGH 6 Ob 31/24p.
The OGH line
Gambling contracts with online casinos lacking an Austrian concession are null and void. Losses can be reclaimed under unjust enrichment law.
