    The operator and its licence

    The portal casinorewards.com does not name an operating company itself. Anyone looking for it will find it in the general terms and conditions of the member casinos we reviewed: the operator named there throughout is Fresh Horizons Limited, based in Road Town, Tortola, British Virgin Islands. The company holds a licence from the Kahnawake Gaming Commission in Canada, licence no. 00972. It does not hold a concession under the Austrian Gambling Act. Yet anyone directing gambling services at players resident in Austria needs exactly that concession. Under the German-language terms, payments are settled through two dedicated companies in Cyprus, Bulex Enterprises Limited and GOITSC Limited, so these names can appear on the bank statement. That clause appears only in the Austrian version of the terms and is missing from the English one. The group’s own Austrian language versions of the casino sites, with amounts in euro, likewise show that it addresses the Austrian market deliberately.

    How casino losses are recovered

    Under settled case law of the Austrian Supreme Court, contracts between Fresh Horizons Limited and players resident in Austria are void. The amounts paid in were transferred without a valid legal ground and are reclaimable on the rules of unjust enrichment (§ 1431 ff. of the Austrian Civil Code). The Supreme Court confirmed this line most recently in 6 Ob 31/24p. The limitation period is thirty years (§ 1478 of the Civil Code).
